The advanced estate plan goes one step beyond the classic plan. As with the classic estate plan, it will ensure that your assets are properly transferred upon your death, that your health care and financial wishes are respected, that your remains are properly disposed of, and that your minor children are cared for.

However, the advanced plan includes a revocable living trust that gives you and your agents some flexiblity in handling your assets in the event of your incapacitation. It also permits you to turn over the management of your affairs to a professional trust management company, and it preserves the privacy of your estate by avoiding probate.

The advanced estate plan does not address any tax planning considerations. There are other benefits of a revocable living trust that we will discuss in the event that it appears the advanced plan is appropriate for your situation.

The advanced estate plan includes the following documents:

  • Revocable Living Trust.

  • Pourover Will. A pourover will distributes all of your assets to your revocable living trust. Your Will also includes the appointment of a guardian for your minor children, your instructions regarding the disposition of your last remains, and your wishes with respect to organ donation.

  • Health Care Power of Attorney.

  • Financial Power of Attorney.

  • Declaration as to Medical or Surgical Treatment (Living Will).

  • Declaration of Anatomical Gift.

The flat fee for the advanced estate plan is $995 for one person and $1195 for a couple. Each flat fee is based on a particular number of hours set aside for drafting that plan. If, due to unique circumstances, your plan exceeds that number hours, you may be charged a fee based on my current hourly rate for the excess time. However, to date, no plan has exceeded the allotted time.
